| Commitments and Contingencies | Note 13—Commitments and Contingencies Legal proceedings — We are subject to claims and legal proceedings arising out of our business. We record costs related to contingencies when a loss from such claims is probable and the amount is reasonably estimable. In determining whether it is possible to provide an estimate of loss, or range of possible loss, we review and evaluate our litigation and regulatory matters on a quarterly basis in light of potentially relevant factual and legal developments. If we determine an unfavorable outcome is not probable or reasonably estimable, we do not accrue for a potential litigation loss. In view of the inherent difficulty of predicting the outcome of claims and other legal proceedings, we may not be able to predict what the eventual outcome of the pending matters will be, what the timing or the ultimate resolution of these matters will be, or what the eventual loss, fines or penalties, if any, related to each pending matter may be. On July 21, 2026, two purported Company stockholders filed a putative class action in the U.S. District Court for the Northern District of Texas against the Company and certain current and former officers, alleging false and misleading statements in the Company’s disclosures. The plaintiffs seek monetary damages and costs and expenses. The Company intends to vigorously defend against these claims. However, given the uncertainty of litigation, the Company is unable to predict the final outcome of this proceeding with any reasonable degree of certainty, nor does it currently have sufficient information to estimate a reasonably possible loss or range of loss with respect to this matter. Representation and Warranty Insurance Recoveries — We have obtained representation and warranty insurance to insure us against potential losses resulting from breaches of certain representations and warranties in connection with certain prior acquisitions. When appropriate, we file claims to recover losses attributable to breaches of representations or warranties by a selling party. The size of claim and amount of recovery can vary, but in some cases could have a material effect on our consolidated results of operations, financial condition or cash flow. Bonding — As of June 30, 2026 and December 31, 2025, we had bid and payment/performance bonds issued and outstanding totaling approximately $9.3 billion and $8.7 billion, respectively. The remaining performance obligation on those bonded projects totaled approximately $1.9 billion and $2.4 billion as of June 30, 2026, and December 31, 2025, respectively.
